JAKARTA, KOMPAS.com - Seorang warga Indonesia bernama Mattari (40) lolos dari ancaman hukuman mati di Mahkamah Tinggi Shah Alam, Malaysia, Jumat (2/11/2018). Mattari divonis bebas usai dituduh melakukan pembunuhan. 
"Alhamdulilah, saya bisa bebas. Terima kasih pemerintah yang sudah perjuangkan keadilan buat saya. Terima kasih," kata Mattari dalam sebuah keterangan tertulis yang terbitkan Kedutaan Besar Republik Indonesia (KBRI) di Kuala Lumpur, Malaysia. Keterangan itu diterima Kompas.com, Sabtu.
Pria asal Sampang, Madura, Jawa Timur tersebut divonis bebas oleh hakim setelah pengacara yang disewa KBRI Kuala Lumpur memohon agar hakim memutuskan Dismissed Amount to Acquittal. Sebab, saksi dan bukti yang diajukan jaksa penuntut umum dipandang sangat lemah.
Sebelumnya, Mattari ditangkap pada 14 Desember 2016 di Kuala Lumpur Lagat Selangor atas tuduhan pembunuhan terhadap warga negara Banglades. Lokasi pembunuhan tersebut terjadi tak jauh dari tempat kerja Mattari sebagai pekerja konstruksi.
Polisi yang menyidik kasus tersebut menduga motif Mattari melakukan pembunuhan karena cemburu terhadap istrinya. Dengan dugaan tersebut, Mattari dituntut dengan Seksyen 302 Kanun Keseksaan dengan ancaman hukuman gantung hingga mati.
Setelah menjalani sekitar enam kali persidangan selama dua tahun, hakim akhirnya memutuskan Mattari dibebaskan dari tuntutan hukuman mati. Pada hari yang sama, Mattari dibebaskan dari penahanan dan langsung dibawa ke KBRI.
Savitri dari Lembaga Bantuan Hukum (LBH) Jakarta secara terpisah mengapresiasi apa yang sudah dilakukan pemeritah Indonesia dengan bebasnya Mattari. Namun dia berharap pemerintah melalui KBRI terus mengupayakan pembebasan Buruh Migran Indonesia (BMI) yang terkena vonis hukuman mati.
"Kami berharap ke depan tidak ada lagi kasus hukuman mati. Kesepakatan antara Indonesia dan Malaysia juga harus diperkuat dengan kerja sama yang mengikat seperti Memorandum of Agreement (MoA)," kata Savitri ketika ditemui di kantor LBH Jakarta.
Pada periode 2011-2018, terdapat 437 WNI terancam hukuman mati di Malaysia. Dari jumlah tersebut, 301 WNI berhasil dibebaskan, 18 diantaranya dibebaskan pada tahun 2018. Saat ini masih terdapat 136 WNI berstatus terancam hukuman mati di Malaysia.
